Some Tax-Exempt Organizations Are Receiving Erroneous Penalty Notices; Relief Available

Practitioners are stating that some tax-exempt organizations have perceived chastisement notices from a IRS for late filing of Forms 990, 990-EZ, 990-PF, and 1120-POL, even yet they perceived an involuntary prolongation and filed during March, as educated by a IRS.

The IRS’s e-filing mechanism complement was not accessible for filing Forms 990, 990-EZ, 990-PF, and 1120-POL from Jan. 1, 2012, by Feb. 29, 2012, so that a IRS could “facilitate systems and programming changes.” Because a complement was being taken down, a IRS extended a filing deadline for Form 990 until Mar 30, 2012, for many tax-exempt organizations with a filing due date during a initial dual months of 2012 (Notice 2012-4). Organizations influenced by a prolongation routinely would have had a filing deadline of Jan. 17 or Feb. 15, 2012. The prolongation practical to these forms either or not a organizations are compulsory to record electronically.

Affected organizations could record electronically between Mar 1 and Mar 30, 2012; however, some that did record during Mar have perceived chastisement notices (Notice CP 141L) from a IRS. Notice CP 141L is sent to taxpayers “who, according to [IRS] records, filed a finish lapse late” (Internal Revenue Manual §

The IRS has suggested practitioners in an email that, if an classification had a due date of Jan. 17 or Feb. 15, 2012, and filed a Form 990, 990-EZ, 990-PF, or 1120-POL in Mar and perceived Notice CP 141L in error, they should take a following stairs to ask chastisement abatement:

  1. Call a series listed during a tip of a notice: 1-877-829-5500; and
  2. Request that a IRS moderate a chastisement in suitability with Notice 2012-4.
